As federal legislation to restrict junk e-mail cleared another Congressional hurdle yesterday, one state whose tough anti-spam bill will be silenced is not happy.
In remarks this week, a spokesman for California attorney general Bill Lockyer said the state takes particular exception with a provision in the federal law that pre-empts its new anti-spam law. California is the only state with a bill that prevents bulk e-mailers from sending messages unless recipients first opt to receive them - a technique already in place in Europe and one favored by anti-spam groups. The state's "opt-in" provisions were to take effect Jan. 1.
