As federal legislation to restrict junk e-mail cleared another Congressional hurdle yesterday, one state whose tough anti-spam bill will be silenced is not happy.

In remarks this week, a spokesman for California attorney general Bill Lockyer said the state takes particular exception with a provision in the federal law that pre-empts its new anti-spam law. California is the only state with a bill that prevents bulk e-mailers from sending messages unless recipients first opt to receive them - a technique already in place in Europe and one favored by anti-spam groups. The state's "opt-in" provisions were to take effect Jan. 1.

"Congress should be ashamed of itself for bowing to the interests of direct marketers and passing a spam-friendly bill that invites unsolicited commercial e-mail from every business in the country," said self-proclaimed "Spam Hammer" Atlanta attorney Pete Wellborn, who has taken on spammers in court. That's just like saying, let's let telemarketers do their damage! :D
